Mới đây, ủy ban quốc hội Brazil đã kêu gọi cơ quan thực thi pháp luật trong nước thực hiện hành động pháp lý chống lại Giám đốc điều hành Binance Changpeng Zhao (CZ) và ba giám đốc điều hành Binance khác.
Khuyến nghị trên được đưa ra là kết quả của một cuộc điều tra về các mô hình kim tự tháp tài chính ở Brazil.
Điều đáng nói là cơ quan thực thi pháp luật Brazil sở hữu một bản báo cáo điều tra toàn diện dài 508 trang dành riêng cho các mô hình kim tự tháp. Tuy nhiên, điều cần lưu ý là mặc dù ủy ban có thể đưa ra các khuyến nghị về cáo trạng nhưng quyết định tiến hành vẫn thuộc về cảnh sát Brazil.
Nếu cảnh sát quyết định theo đuổi hành động pháp lý, các giám đốc điều hành của Binance có thể bị buộc tội. Điều này bao gồm các hành vi phạm tội liên quan đến quản lý gian lận và điều hành một tổ chức tài chính mà không có sự cho phép thích hợp. Ngoài ra, nó sẽ được coi là “tội ác chống lại hệ thống tài chính quốc gia”.
Các bên bị buộc tội trong báo cáo
Ngoài CZ, các giám đốc điều hành Binance ở Brazil là Daniel Mangabeira, Guilherme Haddad Nazar và Thiago Carvalho cũng bị buộc tội.
Chính quyền Brazil cáo buộc rằng bộ ba này cùng với CZ đã tham gia vào các hoạt động liên quan đến quản lý gian lận. Họ cũng hoạt động mà không có sự cho phép phù hợp và cung cấp dịch vụ giao dịch chứng khoán trái phép. Báo cáo còn viết thêm:
“(CZ và những người khác) đã thiết lập một mạng lưới các thực thể pháp lý không rõ ràng, tất cả đều do CZ kiểm soát trực tiếp hoặc gián tiếp, không có mục đích kinh doanh xác định và không có mục đích nào khác ngoài việc trốn tránh việc tuân thủ luật pháp”
Bộ phận của Binance ở Brazil hiện đang bị CVM điều tra liên quan đến hoạt động bán sản phẩm phái sinh.
Lập trường của Binance
Binance mạnh mẽ bác bỏ những cáo buộc vô căn cứ này. Công ty nhấn mạnh rằng họ duy trì vị thế là một đơn vị có trách nhiệm và dẫn đầu trong ngành. Sàn giao dịch do CZ dẫn đầu cũng nhấn mạnh sự hợp tác tích cực của họ với các cơ quan thực thi pháp luật trên toàn cầu. Người phát ngôn cho biết thêm:
“Binance vẫn cam kết và hợp tác với ủy ban nhằm tìm kiếm cuộc tranh luận mang tính xây dựng về những thách thức của ngành vì lợi ích của người dùng và lợi ích của toàn xã hội. Chúng tôi cực lực phản đối việc người dùng hoặc nhân viên của chúng tôi bị buộc tội vô căn cứ về các hành vi xấu và nỗ lực biến Binance thành mục tiêu”
